The Empathy Aviation Limited website includes links to TD Team and Telepathy Aviation Both businesses are in common family ownership with Empathy Aviation and are located various locations in and outside EU. Each of these has its own data privacy policy, which is consistent with this policy.

At Empathy we respect your right to privacy. Any personal data that you volunteer to Empathy, if retained, will be held securely and will only be used for the purposes described in this document. The nature of the internet is such that there is no guarantee or warranty in relation to the security of any information you transmit to us via the Internet. However, we will take all reasonable steps, including appropriate technical and organizational measures, to protect your personal data.

Collection of personal data

Collection of personal data by Empathy arises in various ways:

  • Information that you provide to us when registering as a user with Empathy such as your first name, last name, company name, job title, country of residence, e-mail address, username and any passwords of your choice.
  • Information that you may provide by using the Website or availing of our services on the Website.
  • If you contact us for any reason, we may keep a record of that correspondence.
  • Website visitors can submit enquiries by completing enquiry forms or by submitting email enquiries.
  • Prospective customers can also communicate with us in several other ways e.g.
    • Personal callers to Empathy offices
    • Enquiry directly by telephone
    • Third parties acting on your behalf
    • Through business networking events such as with relevant business associations, Chambers of Commerce etc., where contact details are voluntarily exchanged for business purposes.
  • On becoming a client, Empathy is required by law to collect sufficient details to confirm the identity of the client organization.
  • In accordance with the GDPR definition of the roles of ‘controller’ and ‘processor’ Empathy is a ‘processor’ of Personal Data on its own behalf as ‘controller’, for the purpose of delivering its services to its Clients. Empathy is not a provider of data processing services to third parties and is not a ‘processor’ of data on behalf of any ‘controller’ other than Empathy and, specifically, is not a data ‘processor’ on behalf of its Clients.
  • CCTV monitors the perimeter, entry/exit points and common areas of the buildings.

Use of personal data

The personal data that you provide to us may be processed for the following purposes:

  • To contact you in response to communications you might send us.
  • To provide you with the information and services that you have requested.
  • To provide you with the information and services necessary in the fulfilment of our contractual obligations to you.
  • To contact you in relation to our services, events programme, general news from Empathy, promotional updates and other communications from Empathy deemed to be of possible interest to you, as an individual and/or company.   • As a client company, to provide contact information for your company in the company/team section of the customers directory.
  • As a customer, notifications may be sent to you as and e-mail under two main headings:
    1. Necessary administrative notifications e.g. fire drill notifications, holiday arrangements, etc.
    2. Optional administrative notifications, where you can select which notifications you wish to receive or not.
  • CCTV monitors the perimeter, entry/exit points and common areas of the buildings. This is stored for 30 days to enable viewing of recent footage.

Sharing of personal data

We may disclose your personal data in the following circumstances to the following parties:

  • For Empathy to carry out its operations effectively across its various TD Team entities, there may be occasions when it is necessary to transfer personal data from one Empathy entity to another. Empathy may share your personal data within the TDT Aviation companies for the purposes described here and in accordance with this Data Privacy Policy.
  • Service Providers. We avail of third-party service providers to perform a variety of services on our behalf e.g. personnel lease, third party maintenance, alliances etc. Where necessary we share relevant personal information with such service providers for the purposes described above in “Use of personal data”. Where Empathy uses 3rdparty service providers we require that they adhere to, and operates in accordance with, both this Data Privacy Policy and the GDPR.
  • Other parties where required by law and as necessary in the provision of our services and to protect our rights, property, and the safety of our customers, employees and business partners.
  • Other parties at your company’s request. We may share information about you with third parties when your company requests such sharing.
  • Corporate transactions. In the event of a corporate transaction such as merger, acquisition the companies reserves the right to provide necessary data to relevant parties as may be required in such an event.

Accessing and updating your personal data

Empathy wants to ensure that your data is kept updated, so we do request that changes in your personal and/or your company details are notified to us. In addition, you have the right to request a copy of the personal data held by us about you and you also have the right to have such data corrected where it is inaccurate. Such requests should be forwarded to Empathy Aviation Limited.

Retention of personal data

Empathy will retain the information you have provided for the duration of the relevant contractual agreement. Following the cessation of that agreement Empathy retains the personal information necessary for the purpose of continuing the established business relationship. Following the cessation of the agreement you may apply to have the processing of your data by Empathy ceased. If legally required or if it is reasonably necessary to meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our Terms and Conditions, we may also retain some of your information for a limited period as required, even after you have closed your account, or it is no longer needed to provide the services to you.

Collection of data from children

Our services are provided to the business community and public organizations and are not directed towards children. We do not knowingly collect personal data from children.
